Position Summary

The Corporate Real Estate Attorney will be responsible for representing American Tower in developing, acquiring and preserving the company’s assets by providing legal analysis and services, addressing escalated zoning compliance issues and resolving issues in a timely and financially prudent manner. The incumbent will conduct sophisticated zoning and legal analysis on new construction, potential assets for acquisition, and proposed Outdoor Distributed Antenna Systems (DAS) and document findings. The incumbent will ensure that American Tower continues to set the standard and further enhances its position as the industry leader in zoning practices. This position may be required to represent American Tower in local jurisdictions with the overall objective of supporting the New Site Development, Acquisitions and Outdoor DAS teams. The Corporate Real Estate Attorney will also work on escalated matters and matters requiring outside counsel and litigation. The incumbent will function as a part of the legal team supporting New Site Development, Acquisitions and Outdoor DAS and will contribute both zoning and real estate expertise to that team. The Corporate Real Estate Attorney must be able to apply sound judgment and risk management skills to provide sound legal guidance to the business teams supported.

 
Requirements

ESSENTIAL FUNCTIONS:

·        Conduct substantive legal analysis on real estate, zoning and compliance issues related to American Tower’s new construction, acquisitions and Outdoor DAS infrastructure.

·        Review and analyze zoning ordinances to determine the procedure and requirements to obtain zoning approval for all aspects of tower and Outdoor DAS development and ownership, including compliance issues.

·        Provide legal analysis of real estate issues related to the development or acquisition of wireless infrastructure, including leasing, acquisitions, title and surveys.

·        May draft and negotiate complex legal documents, including Build to Suit Agreements and Asset Purchase Agreements.

·        Draft, negotiate and review other real estate documents as needed.

·        Manage and coordinate zoning projects from receipt of a zoning request through the granting of approval by the jurisdiction including but not limited to preparing Zoning Close-Out Memos and other reporting instruments and performing zoning projects on proposed American Tower assets.

·         Develop and maintain good relationships with zoning officials.

·        Participate in the development of monthly, quarterly and annual zoning reports, including maintaining an accurate zoning database with current project information.

·         Ensure proper execution of American Tower Zoning Processes & Procedures.

·        Ensure that local zoning personnel secure all necessary documents, correspondence, and decisions (with Conditions) and a complete Close-Out memo to place in all tower files.

·        Foster ongoing communication among all teams including Development, Acquisitions, Outdoor DAS, and Operations.

·        Recruit diverse talent to represent American Tower and its customers in local jurisdictions when necessary, including oversight of non-legal vendors.

SUPERVISORY RESPONSIBILITIES:

·         May supervise and manage the performance of one or more Paralegal(s).

EDUCATION AND EXPERIENCE:

·         Bachelor’s degree in Planning, Political Science, Public Policy or Law required.

·         J.D. required.

·         License to practice law in one jurisdiction required.

·         A minimum of five (5) years of previous job related experience required in at least one of the following disciplines: land use, land acquisition, real estate development or telecommunications site acquisition.

·         Supervisory experience preferred.

 

ENVIRONMENT:

Approximately 90% performed in climate-controlled internal office environment working under normal office conditions. Up to 10% may be performed at tower sites. Approximately 50% travel will be required in support of the position’s responsibilities. Attendance at evening and weekend meetings required.

 

While performing the duties of this job, the employee is regularly required to sit; stand; walk; use hands and finger to feel and handle; reach with arms and hands; talk and hear. While performing the duties of this job, the employee frequently is required to stoop, kneel, and crouch; lift weight or exert a force up to a maximum of 25 pounds.
